After shattering pre-sales expectations, the iPhone 5's retail launch will likely have a bit of a cloud hanging over its head.

That cloud in question comes from Apple's competitor, Samsung, which announced that it would add the iPhone 5 to its ongoing legal battle with Apple over patent infringements.

Reuters first reported on the likelihood of the iPhone 5 being dragged into this deepening legal quagmire, and CNET has since confirmed that Samsung will indeed pursue the iPhone 5.

It's not even on shelves yet

After suffering a painful legal setback to the tune of $1.049 billion to Apple this summer, Samsung has wasted no time undermining the iPhone 5.

On the heels of the new iPhone's unveiling, Samsung ran an attack ad against the Apple handset in a newspaper advert and has since made fun of Apple users eager for the new iPhone in a television commercial.

For its part, Apple is continuing to apply legal pressure on Samsung, seeking a ban on the Samsung Galaxy S II and other devices in the United States as the legal dispute between the two companies grinds on.
